There are methods of avoiding litigation, one of them is Mediation, which can lead to a legally binding settlement. If the Mediation fails then of course the claimant can still refer the matter to the courts. However, if you consider the statistics; out of court settlements even after proceedings have been issued in the courts, far outway the number of trials. |

So John Cole isn't sure he understands exactly what Matthew Yglesias is getting at in this post, in which Yglesias says Orson Scott Card (you know, the sci fi writer) called him unpatriotic. Well, not directly: you know how these things go, somebody says something, and then somebody else says something, and - Well, here's what Card said (well, wrote, anyway), in an essay that makes some cogent arguments (a) about win at any cost political strategies, (b) comparisons between Vietnam and Iraq (all of which are largely specious, as he points out), and (c) yes, patriotism. |
