How Juries Think - Sometimes Surprising (Dec 28 2003 23:42 GMT) - Ross Laguzza who consults with lawyers about how juries might react to a certain case is profiled in this story in the Roanoke Times. One example he gives is a sexual harassment case where the victim was a 6 foot 3 inch, ex-Marine who claimed he was harassed by his 5 ft 1 inch, 100 lb female boss. As you expect (otherwise it wouldn't be mentioned in the article), what would seem to be the obvious strategy, turned out to not sit well with potential jurors. |

However, I'm beginning to believe that Rawls is closer in sensibility to the positivists, who banished metaphysics from ethics and reduced all normative language to emotive exhortation, than most commentators have seen. I see Rawls as a sort of post-positivist, not unlike his colleague Quine, combined with a bit of late Wittgensteinian sensibility acquired from his teacher Norman Malcolm. Rawls normative metaphysics is very sparse indeed. He does not believe in moral properties, or any capacity to track objective moral truth. |

In fact, he regularly touts this stance as evidence that he isn't an extreme pacificst. In other words, bin Laden was guilty enough to invade Afghanistan in his persuit -- killing thousands of innocent bystanders in the process (and bin Laden himself if he were caught in the fire). But he wasn't guilty enough to put to death by himself in an electric chair. Imagine Howard Dean were President and had ordered the invasion of Afghanistan. |
