Nigeria [editorial]: The Supreme Court Judgment (Dec 21 2004 23:49 GMT) - When the Supreme Court ruled on the suit brought before it by Lagos State challenging the federal government's withholding of funds meant for its councils, the two-pronged judgment was such that both parties claimed victory. The court had ruled that the president "has no power to suspend or withhold for any period whatsoever the allocation due to local governments in Lagos State." It also held that even when the Lagos State government had the power to make laws that could enable it create new local governments, the law cannot come into effect until the National Assembly amends the constitution to include the new ones. |
